SAN ANTONIO – A leak from inside the land’s highest court regarding a draft opinion seeking to overturn Roe v. Wade talked a lot about the potential fallout from the breach.
Some call it a huge disaster for the US Supreme Court.
“Nothing about this looks good in terms of the integrity of the court itself,” said David Crockett, professor of political science at Trinity University.
Late Monday night, the first draft of the notice that would overturn Roe v. Wade was published by Politico.
Matt Brogen, associate professor of political science at UTSA, says a violation like this is something that has never been seen before.
“A genuine draft majority opinion of the court prior to the court’s formal announcement of the decision is completely unprecedented,” Brogden said.
Crockett thinks there could be a lack of trust within the Supreme Court itself.
“No one will know who the liar is?” said Crockett. “Who leaked this? Is it a clerk? Is he a Supreme Court judge?
Meanwhile, Brogden sees this potentially as an opportunity for the Supreme Court.
“In a way, it’s a public opportunity to learn more about the court and how it works,” Brogden said.
The project is not final, nothing has been legally overturned and the final opinion expected this summer could still be different.
“Obviously the precise language could change in future drafts, and it’s certainly possible the judges will change their minds by then,” Crockett said.
Chief Justice John Roberts released a statement on Tuesday saying that while the leaked project was genuine, it did not represent a court ruling. He also mentioned that he ordered the Marshal of the Court to open an investigation into the source of the leak.
